Rule 16
Compensation in case of dismemberment
: (1) In case of dismemberment of a worker or employee in an accident while doing work prescribed by the tea plantation, based on the percentage of disability as mentioned in the schedule in relation to such dismemberment, if the disability of such worker or employee is 100 percent, the salary for four years will be paid at the rate of wages earned by him. The manager has to give a lump sum amount equal to such workers or employees.
(2) In accordance with this rule, when the manager compensates the worker or employee concerned for the amputation of the limb, the Damasahi shall determine the amount of compensation to be given for the amputation of the limb equal to the percentage of the disability caused by the amputation as mentioned in the schedule, based on the amount of wages for four years equal to 100% of the disability.
